ARBITRATION: MOST SUITABLE FOR INTERNATIONAL DISPUTES
The Solicitor General of the Federation and Permanent Secretary, Mr Taiwo Abidogun Esq, has said that arbitration is suitable for international disputes, when the parties to a dispute, are not domiciled in the same country.
Abidogun stated this in his welcome address, at the Seminar on International Commercial Arbitration and Advocacy Skills for Government Lawyers, organised by the Federal Ministry of Justice, in Collaboration with Curtis, Mallet -Prevost Colt & Mosis LLP, on Tuesday, November 29, 2016, in Abuja.
Represented by the Director, Solicitor Department, Mrs Olushola. O. Moore, the Solicitor-General emphasised that, the knowledge of the topic of the seminar is very crucial for every Lawyer, most importantly, Government Lawyers, especially the in this era when the need for arbitration is inevitable.
She further stated that “As a result of their inter-dependency, disputes are inevitable and parties elect amicable settlement, obtainable in a private and confidential nature with binding effects. The elements are made up of alternative dispute resolution mechanism in the form of mediation, conciliation and arbitration”.
She explained that commerce and business are ancient activities and are presently, the only avenue through which nations are inter-connected with one another.
Moore highlighted that, parties in commerce and business, opt for arbitration because of its merits; such that, it is simple and flexible in that it guides itself on the will of the parties. Also, arbitration gives quick remedy and provides confidential procedure which helps to establish calm atmosphere between the claimant, defendants, and arbitrators encouraging amicable settlement.
She hoped that at the end of the seminar, participants would be better equipped not only in arbitration but also in advocacy skill.
She expressed her profound gratitude for the supportive efforts from Curtis, Mallet- Provost, Colt and Mosis LLP and the facilitators from the United Kingdom, Mr Peter F.Stewart (Partner), Mr David Hesse (Partner) and Mr Timi Balogun (Counsel).
