False Asset Declaration: Prosecution counsel closes case against Senate President

ABUJA (CCT’ Report)- The prosecution Counsel, Mr Rotimi Jacob (SAN), on Thursday May 4,2017 at the ongoing trial on alleged false asset declaration closed his case before Justice Danladi Yakubu Umar’ led Code of Conduct Tribunal.

According to a statement released to the press by CCT’s Press and Public Relations Unit on Friday May 5, the Tribunal issued out an order of subpoena duces tecum which compelled Mr Bayo Dauda, a Group Head Public Sector, covering South West of Guarantee Trust Bank, to give evidence before the court in Abuja.

However, the examination in chief, cross examination and re-examination was completed by both litigants, leading to the closure of the case by the prosecution. On his part, the Defence Counsel applied for a date for a no case submission application.
He said; ‘‘My lord we intend to make a no case submission, we wish to ask for Tribunal directive for record of proceeding be made available to us for us to go through and apply for the no case submission.

We also humbly apply his lordship to grant us adjournment for the period of two weeks to enable us study it and come up with our application with effect from when the registry submitted the record to us’’, he further requested.

However, during the cross examination of the Prosecution Witness 4, Mr Bayo Dauda, of the GTB told the Tribunal that the contentious document inquired by the Tribunal patterning the transaction of the defendant cannot be found. He maintained that he personally joint the search team and search at their head office in Lagos and backup in Ilorin office, still could not be found, because it was a transaction that was done long and the said loan has been defrayed since before now.

The Chairman of the Tribunal, Justice Danladi Umar, assisted by Hon. Justice William Agwadza Atedze, adjourned to 8th June 2017, adoption for the litigants written addresses.
